Defamation case against Owaisi reaches S.C.

His own case became a snake’s throat

New Delhi (News Report: Matiur Rehman Aziz) – Member of Parliament Asaduddin Owaisi had filed an FIR against Heera Group of Companies in 2012 on the basis of suspicion, in which Asad Owaisi lost his own case. Now, after losing his own case, Asad Owaisi is facing a defamation case of Rs 100 crore from Heera Group of Companies. Asad Owaisi has lost the defamation case in the lower court, but managed to get a decision in his favor from the High Court as “The High Court of Telangana advised Heera Group to first get acquitted in its other cases.” After the arbitrary decision of the High Court of Telangana, the company CEO Dr. Nowhera Sheikh has now filed a defamation case against Asad Owaisi in the Supreme Court for hearing. The Supreme Court has accepted Dr. Nowhera Sheikh’s case against Asad Owaisi for hearing. Therefore, it is now said that Asad Owaisi’s own case has become a mole in the throat of a snake, which Asad Owaisi is neither swallowing nor spitting out. Such a retaliation against snake-like people in the arrogance of their temporary position and status is the need of the hour. People who are drunk on influence forget that it is the people who take them to their status and status, but these leaders write stories of oppression and oppression on them after winning the votes of the people. It has been observed that Asad Owaisi has made immense efforts to get rid of the defamation case. Asad Owaisi has repeatedly demanded from the lower court and the High Court that there is no need to hear this case. And many times he has threatened Dr. Nowhera Sheikh with his supporters. Dr. Nowhera Sheikh said in one of her press conferences that groups of Asad Owaisi’s supporters gather near my offices and houses in numbers of several dozen, and keep moving there for a long time so that Nowhera Sheikh gets scared and withdraws the defamation case from Asad Owaisi. Similarly, a telephone call was mentioned, in which a supporter of Asad Owaisi threatened to kill him. An emailer who was identified as being from Asad Owaisi’s party said that withdraw your case against Asad Owaisi or we will build your graves between your offices and houses. In short, the same case has now become a noose around Asad Owaisi’s neck, from which Asad Owaisi is using various tactics to get rid of it, and it remains to be seen how long the same defamation case filed against Asad Owaisi will continue to cause disgrace in the form of defamation in the coming days.

In the initial investigation, the police took the FIR seriously, but as evidence gathered, the matter started to turn upside down. The courts found that Owaisi’s allegations lacked solid evidence, and they mostly seemed like political propaganda. As a result, the lower court (Hyderabad Magistrate’s Court) accepted the defamation case against Owaisi in 2015, under sections 499 and 500 of the IPC. The court lost and recommended compensation to the Heera Group, which later reached Rs 100 crore. The local court in Hyderabad termed Owaisi’s statements as "false and harmful”. The court noted that Owaisi defamed the company without evidence, causing serious damage to the personal and business reputation of Dr. Nowhera Sheikh and the Heera Group. The court ordered Owaisi to pay Rs 100 crore in damages, one of the worst cases of defamation. Owaisi called the verdict a “political conspiracy” and appealed. Owaisi filed an appeal in the Telangana High Court, where he argued that his statements were part of freedom of expression (Article 19 (1) (a)) and amounted to political criticism. The High Court initially stayed the case, but in 2023, there was an interesting twist. The court advised the Heera Group to “first seek release in your other cases”, as separate cases were pending against the Heera Group. The verdict was ostensibly non-committal, which went in Owaisi’s favour, but in reality it was prolonging the case further. Dr. Sheikh called it “judicial delay” and decided to immediately move the Supreme Court. In late 2024, Dr. Nowhera Sheikh filed an appeal in the Supreme Court of India. A bench of the Supreme Court (headed by Chief Justice D.Y. Chandrachud or his successor) accepted the case in June 2025 and began hearing against Owaisi. The court noted that “defamation laws cannot be used for political vendetta, but false allegations are also punishable.” In the most recent hearing (August 2025), the Supreme Court has summoned Owaisi and is considering the amount of damages. The next hearing is expected in September 2025. This stage is the most difficult for Owaisi, as the decisions of the Supreme Court are final.
