Dr. Nowhera Sheikh declares all previous matters null and void
New Delhi (Report: Mutiur Rehman Aziz) Heera Group of Companies Chairperson and CEO Dr. Nowhera Sheikh has issued a legal notice and issued a strict warning to those dealing, contracting, trading and negotiating with any property of Heera Group. Dr. Nowhera Sheikh said that the authority to dispose of all kinds of properties of Heera Group and to hold meetings and agreements is with the Chairperson, i.e. Dr. Nowhera Sheikh only. Behind Dr. Nowhera Sheikh’s legal notice is the illegal actions being taken by government agencies and the aim of selling properties at arbitrary prices. It should be noted that in the past, the Supreme Court had issued instructions to handle the matters going on between Heera Group and government agencies in the PMLA Court. The Enforcement Directorate misdirected this instruction of the Supreme Court and without entering the PMLA Court and The trial court issued a notice to auction the properties of the Heera Group, in response to which the CEO, Dr. Nowhera Sheikh, has issued a notice and warned those who are involved in any kind of transaction with the properties of the Heera Group in advance that its powers are ours alone, any kind of purchase or sale will be considered an illegal and arrestable act.
In an important legal notice issued by the Heera Group of Companies, Dr. Nowhera Sheikh has said that this binding legal notice is issued by the sole legal owner and authorized representative of the Heera Group that no movable or immovable property of the Heera Group (freehold, mortgage, lease, or under legal process) is available for sale, transfer, lease, mortgage, or any kind of disposal. Any disposal is strictly prohibited without the written approval of Dr. Nowhera Sheikh. All properties of the Heera Group are protected under the attachment of the Enforcement Directorate (ED). These properties cannot be sold, transferred, auctioned, or used in any way. Any interference with such properties will be illegal and will be prosecuted under the provisions of contempt of court, obstruction of justice, and fraud.
The legal notice further states that all mandate letters, powers of attorney, or permits previously issued by the Heera Group are hereby immediately revoked and declared null and void. Banning meetings/agreements without permission, CEO Dr. Nowhera Shaikh said that no meeting, agreement, or transaction related to the Heera Group properties can be entered into without written permission. Meetings with external parties, investors, banks, or government officials will be permissible only with the presence or signed permission of Dr. Nowhera Shaikh. Warning of legal enforcement, it said that any violation of this notice will be considered illegal and will be subject to civil and criminal action under the Indian Penal Code, the Companies Act, and other applicable laws. Stating that the notice will be implemented immediately, he said that this notice is effective immediately and cancels any previous permission. The public is requested to beware of any unauthorized claims or activities related to the Heera Group. The legal notice is signed by Dr. Nowhera Sheikh at the end.
In short, the Heera Group of Companies has warned all people to take legal action against the arbitrary and self-interested way of the agencies, and to take them to court for legal action. Contrary to the Supreme Court’s order to proceed under the PMLA Act, the Enforcement Directorate went to the court without the PMLA to enforce the value of the properties of the Heera Group and issue a notice to sell it. It is considered illegal and a violation of the integrity of the country. Different courts across the country have spoken out strongly against similar arbitrariness by the ED. Just a few days ago, the Supreme Court of India said that "ED should stop acting like goons.” Therefore, somewhere in the Heera Group of Companies case, the ED is taking undue advantage of its powers and beyond its powers. Selling the properties of any company at very low prices without taking legal action in violation of the Supreme Court order can only be interpreted as breaking the company and weakening the country.
