The Main Culprits Behind the Systematic Destruction of Aalima Dr. Nowhera Shaikh
New Delhi (News Release : Mitiur Rahman Aziz) Aalima Dr. Nowhera Shaikh, a prominent leader, has been subjected to relentless legal persecution that has led to the defamation and eventual destruction of her reputation. The primary actors in this campaign are the Enforcement Directorate (ED) and other accomplices who have systematically oppressed Dr. Shaikh, disregarding court orders, and orchestrating a campaign to dismantle her legacy. This article delves into the key instances where these entities have played a pivotal role in her legal and reputational downfall. Background: The Contempt Petition Against the Directorate of EnforcementAalima Dr. Nowhera Shaikh is currently embroiled in a legal battle involving a contempt petition against the Directorate of Enforcement (ED). This petition argues that the ED willfully and deliberately disobeyed explicit orders issued by the Hon’ble Supreme Court of India, thereby exacerbating the legal challenges faced by Dr. Shaikh. The petition highlights the ED’s role in disregarding court orders and perpetuating a campaign against her.High Court of Telangana’s Directives: A Clear Mandate Ignored by the EDOn December 23, 2019, the Hon’ble High Court of Telangana issued a crucial judgment granting Dr. Shaikh bail and directing that all complaints filed by investors be handled solely by the Serious Fraud Investigation Office (SFIO). Despite this clear directive, the ED ignored the High Court’s order, continuing its investigations and issuing a Provisional Attachment Order (PAO) on August 16, 2019. This deliberate defiance of the High Court’s judgment is a clear example of the ED’s role as the main culprit in undermining Dr. Shaikh’s legal protections. The Supreme Court’s Intervention: Reinforcing the Rule of Law Ignored by the EDFollowing the High Court’s judgment, the Hon’ble Supreme Court of India reinforced the directive that all investigations related to Dr. Shaikh’s case should be transferred to the SFIO. However, the ED once again failed to comply with this order, issuing an eviction notice to Dr. Shaikh on May 17, 2024, in direct contradiction to the Supreme Court’s instructions. The ED’s continued involvement, despite explicit court orders, underscores its role in the systematic destruction of Dr. Shaikh’s reputation.Illegal Raids and Seizures: ED’s Campaign of Harassment and DefamationOne of the most egregious actions taken by the ED was the series of raids and seizures conducted on Dr. Shaikh’s properties and those of her relatives and employees. These actions, carried out in blatant violation of court orders, were strategically aimed at defaming Dr. Shaikh and destroying her reputation. The ED’s arbitrary and illegal actions further demonstrate its role as the main culprit behind the campaign to dismantle Dr. Shaikh’s legacy.
The Supreme Court’s Order on Property Attachment: ED’s Non-ComplianceOn March 28, 2023, the Supreme Court issued a significant order in Special Leave Petition (Crl.) Nos. 1675-1676/2020, which further highlighted the ED’s contemptuous actions. The court acknowledged that prospective purchasers of Dr. Shaikh’s land were fully aware of the ongoing disputes but were still willing to proceed with their investments. The court’s primary concern was ensuring that the claims of the investors were addressed. To facilitate this, the court allowed for the lifting of the ED’s attachment on the land, provided that the purchasers deposited approximately Rs. 641 crores. The Supreme Court’s order stated:“…if prospective purchasers knowing the position aforesaid are willing to deposit the amount of Rs.641 crores odd, we are inclined to permit them to make the deposit and on such deposit being made the attachment of ED will be lifted…”
Despite this clear directive, the ED failed to comply with the court’s order. An encroachment occurred on the property owned by Dr. Shaikh, which was under attachment by the ED. This property was intended to be used to repay investors, as per the Supreme Court’s order. However, the ED’s inaction allowed unknown individuals to encroach upon the property, further complicating Dr. Shaikh’s efforts to comply with the court’s directives. The ED’s failure to protect the attached property, combined with its continued interference in Dr. Shaikh’s legal affairs, demonstrates a calculated effort to undermine her legal standing and to prevent her from fulfilling her obligations as directed by the Supreme Court. Conclusion: ED and Accomplices as the Architects of Dr. Nowhera Shaikh’s DownfallThe series of legal actions taken against Aalima Dr. Nowhera Shaikh, particularly by the Enforcement Directorate, reveals a systematic campaign of oppression and defamation.
The ED’s blatant disregard for court orders, its arbitrary raids and seizures, and its failure to protect attached properties all point to a deliberate attempt to destroy Dr. Shaikh’s reputation and to obstruct the course of justice. Dr. Shaikh has been subjected to an intense and unwarranted legal scrutiny that has not only defamed her but has also caused irreparable damage to her personal and professional life. The legal system, which is supposed to uphold justice, has instead been used as a tool of persecution against her, raising serious concerns about the misuse of power and the erosion of legal protections in her case. In light of these events, it is clear that Dr. Shaikh’s legal battle is not just about defending her rights but also about resisting a larger campaign aimed at dismantling her legacy and reputation. The actions of the Enforcement Directorate, in particular, must be scrutinized and held accountable for their role in this systematic destruction.
